The following terms and conditions apply to individuals or entities who are accessing or using the Program, both as a merchant (“we” or “merchant”) who is the seller and an affiliate (“you” or “affiliate”) who refers customers to purchase products or services from the merchant.

By participating in the Program, the Affiliate agrees to use the Program in the manner specified in, and is bound by these Terms and Conditions. If you do not agree to these Terms and Conditions in their entirety you are not authorized to register as an Affiliate or participate in the Program in any manner.

1. Approval or Rejection of the Registration

We reserve the right to approve or reject ANY Affiliate Program Registration in our sole and absolute discretion. You will have no legal recourse against us for the rejection of your Affiliate Program Registration.

2. Affiliate Links and Coupon

1. Affiliate links are automatically generated, but you can also generate an affiliate link for a specific product or collection. If a person clicks on someone else’s referral link and then later they click on yours, yours is the one that counts.

2. Affiliates may or may not be assigned a unique coupon code with details and usage clarified on the Dashboard. If a customer clicks on the affiliate link and uses the coupon code at the same time, you will not receive a double commission. If you’re not assigned a unique coupon, then you’re not allowed to promote the coupon.

3. Affiliates may advertise the merchant's website on online channels such as Facebook and Instagram or offline classified channel ads, magazines, and newspapers.

4.  All our affiliate programs run within a single financial year, ending 28 February. The affiliate (You)  will have to apply for a new code after the 28th of February each year, and any coupons or links provided in previous financial years will not work or be accepted in the next financial year.

5. We reserve the right of renewing or deactivating links and coupons in our sole and absolute discretion.

6. Referrals cannot be made to customers who have the same physical address of the affiliate

7. Affiliates cannot use their own discount codes.

3. Commissions and payment

1. Refer any customer who has not purchased from the store yet (a “new customer”) to complete a purchase on our website, and you will get a commission amount which is calculated based on an agreed upon Commission structure. The Commission amount is dependent on the order value and does not include extra fees (tax, shipping cost,...).

2. In order to receive a commission, you need to specify your payment details in the Settings section.

3. Payments will only be sent for transactions that have been successfully completed. Use of the Affiliate Program is subject to a fair use policy which gives the merchant the right to review each and every referral order. The status of your commission is displayed in Commission tab and any paid commission will be listed on the Payment tab. Transactions that result in returns or refunds will not be paid out.

4. Each customer can only apply your coupon code once

5. Your link and coupon may be used by multiple new customers, and you will earn a commission on all successful sales

6. Once the order is fulfilled, your account will be credited with your commission amount.

7. You are welcome to request your reward at any time.

8. If you choose to be rewarded by a coupon to the value of your credit, this will be given to you within 10 business days and be valid for 12 months from the time your credit was given .

9. If you choose a cash payout, we will process the payment within 25 business days of your request. There is an admin fee of R10 per cash payout deducted from the commission so you should not request payouts more than once a month.

10. Cash payouts cannot be made if the affiliates account has a balance below R10

4. Marketing tools

We may share promotional media such as banners, logos or specific collection/product promotions to you through the Marketing tools tab. You can download the media or get the HTML embed code in order to share these assets on your media channels.

5. Network

1. IF the Network tab is activated, you can invite others to become sub-affiliates (also known as downline affiliates). If any sub-affiliates bring sales to the merchant's shop, the main affiliate (you - also known as the upline affiliate) will also get a 'network' commission. The amount depends on the merchant’s settings.

2. To invite other affiliates into the system, share the network link and anyone who clicks on that link and signs up will become a sub-affiliate.

6. Cookies (Don’t get hungry)

1. We use a cookie to track people who have clicked on your link, so they need to be using cookies for us to track them.

2. If a person doesn't allow cookies or clears their cookies then we can't track them so can't pay earnings on that person's activity.

3. 'Cookie days' are mentioned on the Affiliate registration form. This is how long we track customers after they click on your link. The tracking day will start from the time a customer clicks on the affiliate’s link or enters a coupon. Within the cookie time, the first order made by this customer will automatically result in commission for the affiliate (There’s no need for the customer to click on the affiliate link again).

4. If a customer clicks on your link today, they have a certain number of days to complete their order (using the same browser and device that they initially clicked the link from) in order for you to earn a commission. If the customer does not purchase within the stated number of days, they will have to re-click the link in order for you to get a commission and for them to get a discount.

5. NB : This does not apply to discount codes and as long as a customer enters a discount code before the end of the financial year, the discount code will be valid.

7. Removal from Referral Program

If an affiliate wishes to be removed from the affiliate program, they can do so by sending a request to {merchant_email}, with the subject being AFFILIATE REMOVAL.

Personal Information Controller

Any personal information provided to or gathered by the affiliate program under this Privacy Notice will be stored and controlled by the affiliate app (the data controller).

Information collected from Merchants

When merchants uses the app, we are automatically able to access certain types of information from your  shop such as email, first name, last name, shop information (shop domain, shop currency, shop address …). We collect this information to provide you with our Services; for example, to confirm your identity, contact you, provide customer support when you contact us, provide you with advertising and marketing activities.

Information collected from Affiliates

When an Affiliate signs up to join a program, we collect some information to inform merchants such as email, personal information, payment details and social network information etc. This information will help the merchant evaluate the affiliates background and potential, and to assist with processing specific activities within the app and to contact the affiliate if need be.

Information collected from Customers when visiting the merchant's website

In order to track a referral order, when customers visit the website and make a purchase, the affiliate app system will collect information about the order such as the total order value, order items, order ID etc.

About Cookies

“Cookies” are data files that are placed on your device or computer and often include an anonymous unique identifier.

Cookies are created when a user's browser loads a particular website. The website sends information to the browser which then creates a text file. Every time the user goes back to the same website, the browser retrieves and sends this file to the website's server.

Because cookies allow you to take advantage of some of the Affiliate marketing system’s essential features, we recommend that you leave them turned on.

Information sharing

Ensuring your privacy is important to us. We do not share your personal information with third parties except as described in this privacy policy. We may share your personal information with third-party service providers who we employ to process specific functions; examples include providing email marketing activities, analyzing data and other marketing support etc. Third-party service providers have access to personal information only as needed to perform their functions and they must process the personal information in accordance with this Privacy Policy.

We may also disclose your personal information to any third party with your prior consent.

Use of the program by Children

The program is not intended for children. If you are under 13, you may use the affiliate marketing system only with the supervision of your parent or guardian.

Your Rights

The app understands that you have rights over your personal information, and takes reasonable steps to allow you to access, correct, amend, delete, port, or limit the use of your personal information. If you are using the system and wish to exercise these rights, please contact us through info@zalemart.co.za. We may require that you provide us with acceptable verification of your identity before providing access to such information.
